Prison Letters Project
Join us for a conversation first with Emily Bazelon and John J. Lennon and then more from those at Yale running the Prison Letter Project

The Prison Letters Project was started by Lecturer in Law Emily Bazelon ’00, a staff writer for The New York Times Magazine, and brings together the Law and Racial Justice Center at Yale Law School and Freedom Reads, a project hosted by the Justice Collaboratory at Yale Law School.
The inspiration for the project came from a letter Yutico Briley sent Bazelon in 2019 when he was in prison in Louisiana, serving a 60-year sentence for armed robbery. Briley wrote of his claims for innocence. Bazelon wrote for The New York Times Magazine in July 2021 about his successful fight for exoneration, with her sister Lara Bazelon, a law professor at the University of San Francisco, representing him.
Bazelon knew that after the Briley story ran, she would receive more letters describing excessive sentences, claims of innocence, or other legal problems. She said that journalists who write about criminal justice often receive letters from incarcerated people.
“I get a lot of mail from people in prison,” Bazelon wrote in her original story. “It’s impossible for me to read all of them, and though I don’t feel good about it, many go unanswered.”
The Prison Letters Project seeks to answer those letters and also spotlight the voices of the writers. With the permission and participation of the writers, portions of the letters from prisoners and their advocates are logged into a database and can be read online. Freedom Reads, which works to bring libraries into prisons across the country, hosts the database. Dwayne Betts ’16 is the founder of the organization.
“When we started the Prison Letters Project, Dwayne and I talked about how we hoped that if readers hear what we hear, when we get these letters, it will help to bring more resources to incarcerated people, whether that's in the form of journalism, or legal representation, or volunteering to be a pen pal,” Bazelon said. “I've been struck too by how the communication between the people who write to us and the law students who answer is itself a benefit, in terms of learning and respect.”
Three current Law School students — Partha Sharma ’23, Natalie Smith ’23, and Johnathan Terry ’23 — have worked with Bazelon to log the letters and launch the project. Joel Sati ’22 also worked on the project last year.
“As students, we’re in a unique position to be able to help respond to the many letters and requests for help sent to professors and advocates at schools like ours,” Terry said. “It’s rewarding to be able to leverage that position to help people whose stories might otherwise go unheard, and to lend some humanity to people who too often are denied it.”
The New York Times Magazine announced the Prison Letters Project in a Sept. 2 newsletter by prison journalist John J. Lennon, who is incarcerated in upstate New York and has been published in The New York Times, Esquire, and elsewhere. He will take the lead in writing future newsletters.
“As a journalist, especially one in prison, I'm always writing for some issue that speaks to the collective, which is important,” Lennon said. “But it feels terrible sometimes to have this voice and be unable to write about an individual's apparent injustice. Now, with the Prison Letters Project, we do have the resources and we can highlight some of these injustices.”
Kayla Vinson, Executive Director for the Law and Racial Justice Center at Yale Law School, said that there is value in replying to each letter received.
“The social isolation of prison can be devastating,” Vinson said. “By replying to the letters, this project extends a connection to the outside world to the writers.”
The project intends to create a way for advocates of all kinds to learn about the letter writers’ experiences and offer help and resources.
“Prisons severely limit the exchange of communication between those inside and outside their walls,” Smith said. “I see this project as a way of bridging that barrier. Building a platform to facilitate connections between those inside and those who might support them on the outside has been the most meaningful part of this project to me.”
For the Law School students involved, the project has become a meaningful part of their legal education in a short time.
“It’s been rewarding to contribute to a project to spread claims of wrongful conviction and excessive sentencing by those incarcerated,” Shama said. “We’re very aware of how important the chance to spread their stories is to those who are in prison and seeking to share their claims with potential advocates.”

How Do You Know if You're Doing Right by your Clients? Using Experience Surveys to Advance Client-Centered Representation
Client-centered representation means listening to the people we represent and being responsive to their needs and concerns. The opinions of our clients about our work are ultimately the most important metrics of our success. Formal surveys are one way we can connect with the people we serve to seek their input about their engagement with us, better meet their needs, and hold ourselves accountable to them.

In this panel, we will discuss our work conducting client experience services over the past 20 years, with particular focus on techniques we have developed more recently to conduct surveys during Covid. We will discuss the successes and challenges we have encountered in collecting candid information from a large cross-section of clients, across practices, about working with our office to understand general trends that will help inform our representation. We will also discuss our experiences developing survey methodology and analyzing data, as well as closing the feedback loop by integrating what we've heard into our work.

#SAYHERNAME: The intersection of the child welfare system, law enforcement, and other barriers to family reunification, and how family advocates can help flip the script
Charleena Lyles was a pregnant mother of four children facing intersecting barriers of involvement with child welfare, criminal justice, domestic violence victimization, and poverty when, in June 2017, she was murdered by law enforcement in her own home in the presence of her children.  Her story serves as a vivid reminder that many parents, particularly Black and brown parents, are constantly walking a tightrope and are navigating interconnected systems and requirements in order to reunify their families.  This facilitated workshop/discussion group will introduce you to Charleena's story, and through learning about Charleena, we will discuss how clients in the child welfare system, particularly our BIPOC clients, face intersecting barriers of family policing, race-based discrimination, criminal justice involvement, domestic violence victimization, and poverty and benefit-related requirements.  We will discuss the real, practical ways clients in our child welfare cases wish to receive our advocacy, and how we can lift up our parent clients' voices in advocating for them.  We will also talk about concrete solutions that attorneys, social workers, parent allies, and other advocates can do now and can work towards in order to help families reunite faster and easier.

Storytelling is an act of agency, yet oftentimes our clients’ stories go unheard and it is up to us, as their attorney, to help them regain their agency. As defense attorneys we are constantly combatting the danger of the single story or narrative of who our client is that is contained in the indictment, the discovery, and the arguments put forth before the courts. In this training we will explore the different ways to tell our clients’ stories throughout the life of a criminal case by focusing on storytelling in pleadings. Unintended Trauma from Defending Children
Nationwide, many of the children in juvenile and child abuse and neglect/dependency proceedings are victims of violence, crime, abuse, neglect, or emotional trauma. In fact, the majority of youth involved within the criminal legal system have been exposed to trauma at some point before their 18th birthday. But the trauma these children have experienced does not stay contained by their case or in the courtroom. It rubs off on defense counsel with public defenders, advocates, social workers, paralegals, and other members of the team facing greater risk of secondary trauma symptoms. Secondary or vicarious trauma is not something a bubble bath or good night's sleep can fix. It can affect work performance, client relationships, personal relationships, and take a toll on our well-being. This presentation will explore vicarious trauma (the secondary trauma we pick up by witnessing trauma in others), what trauma is, how it is not defined by one diagnosis, and what effects it can have on those bearing witness to trauma through direct representation.

Initial Appearance and Charging Time: Efforts to Reform the Earliest Stages of the Criminal Process
Most Americans believe that if they are arrested, they will promptly receive a lawyer, see a judge, and have the opportunity to argue for their freedom. Instead, thousands of newly arrested people are held behind bars for days or weeks (or sometimes even for months) before they ever see a judge or an attorney. While the initial appearance is intended to inform defendants about their constitutional rights and provide an opportunity to argue for release, the Supreme Court has never explicitly guaranteed the right to a prompt and meaningful first appearance. As a result, there is little structural incentive for cash-strapped and resource-deprived criminal justice systems to provide prompt access to this essential procedure. Many states permit lengthy post-arrest detentions without judicial process and fail to provide counsel at initial appearance. In many jurisdictions, the initial appearance crisis is exacerbated by lengthy delays in filing formal charges. No constitutional doctrine requires prosecutors to make speedy decisions about filing formal charges. It may be weeks, or even months, before a prosecutor “screens” a case and decides whether to decline or accept the charges against a defendant. Until then, uncharged defendants languish in jail for weeks or months.
This session will examine initial appearance and charging time laws across the country, as well as discuss promising practices, opportunities for reform, and the role of public defenders in improving the early-stage criminal process.

Each one of our Flikshop postcards are filled with words of love, emoji's, confessions of yearning, and some pain. They tell a story, and our founder Marcus Bullock knew that we needed to figure out a way to leverage this love to help end recidivism around the globe.

When Marcus was 15 years old, he was arrested and sentenced to spend 8 years in adult maximum security prisons. By the time he served the first 2 years he became very dark and depressed, so his mom made a promise to him in a prison visiting room. Her promise was to mail him a letter or picture every day for the remaining 6 years of Marcus' sentence.

It were those letters and photos, that consistent family connection, that helped Marcus survive his time of incarceration. Distance, time, and separation all create challenges for families to maintain the emotional and relational support systems so desperately needed not just by their incarcerated loved ones, but their children, siblings, spouses, parents, and friends.

Communication during times of incarceration can be complicated and expensive. Flikshop wanted to provide a means for families to send photos and encouraging messages without breaking the bank. This led to the creation of our Flikshop Angels. Flikshop Angels are monthly subscription or one-time donors who purchase credits on behalf of families looking to stay connected to their incarcerated loved ones. This allows those families to remain strong during difficult seasons, and for their loved one to feel supported despite distance or separation.

Today, Flikshop works hard to keep every person in every cell connected to their family members and other community resources, prior to their release...just like Marcus' mom did while he was in prison.

The ABA Criminal Justice Section has recently approved its first set of Standards on Diversion.  How can they effectively be utilized to help offset the disproportionate number of poor people of color from criminal prosecution and its collateral damages?  Many stakeholders in this space have developed internal policies and practices for diversion and alternatives to incarceration programs, but often without the guidance of uniform and multi-faceted standards that emphasize a public health perspective for the establishment, implementation, and evaluation of diversion programs.  This presentation will focus on the unique role that public defenders can play in advancing fair and effective alternatives to the traditional arrest, prosecution and sentencing of persons who suffer from substance use and mental health disorders.

Interstate Issues in Criminal Defense After Dobbs
In the wake of the U.S. Supreme Court’s decision in Dobbs v. Jackson Women’s Health Organization overruling the constitutional right to an abortion, many states have begun enforcing old statutes or enacting new ones that severely restrict access to and provision of reproductive healthcare.  In other states, the right to reproductive freedom is protected under state law.  But people in those “protected” states may nonetheless face legal action from prosecutors in other states who are seeking to enforce their restrictive laws across state lines.  This discussion will discuss potential issues that criminal lawyers might face in defending their clients in these interstate cases.

The Misdiagnosis Epidemic: Clinicians Harming Clients through Misdiagnosis of ADHD
Many clients present to evaluators, psychiatrists, and primary care physicians with symptoms of distractibility, inattention, and hyperactivity.  While this symptomology can be indicative of several DSM disorders, many clinicians default to a diagnosis of ADHD when ethically they are mandated to rule out alternative diagnoses first.  A misdiagnosis of ADHD can be actively harmful to our clientele, especially if ADHD treatment is ineffective.  Mitigation in exploring more applicable explanations and diagnoses can have profound implications for the client.

Combatting unconscious racial bias is something that is routinely discussed in public defender offices, but that conversation tends to center on the disruption of unconscious racial bias toward clients of color. There is very little discussion, however, around how unconscious racial biases impact interactions between colleagues in public defense spaces. Of particular concern is how an unconscious perception of people of color solely as criminal defendants, can lead to negative and/or microaggressive interactions between white public defenders and their colleagues of color. This workshop aims to have the uncomfortable but necessary conversation around how unconscious racial bias impacts workplace dynamics, and to provide a space to consider ways to disrupt these biases.

As the Supreme Court has recently emphasized, “Some decisions . . . are reserved for the client.” But not all clients make great decisions, and when they’re making decisions that are harmful for their case, what is the role of defense counsel? Leveraging Data and Analytics to Increase Funding and Enhance Indigent Defense Services
The Santa Barbara County Public Defender’s Office has successfully utilized data to advocate for increased funding and resources.  Over the past five years as the office has shifted towards data-driven and evidence-based practices, the Public Defender’s Office has increased its benefited positions by 59% and its overall budget by over 66%, which amounts to a nearly seven-million-dollar increase. Throughout our workshop, we will provide examples of how the office achieved these accomplishments through the expansion of data capacity. Specifically, we will demo the office's recently launched Power BI data dashboard and discuss how we are utilizing the dashboard to report on office metrics and build data transparency across public safety agencies. This presentation focuses specifically on Defender voices and how services can be enhanced in Indigent Defense.   Additionally, with the focus on Holistic Defense, these data metrics from our advocates help provide the great client outcomes we’ve been able to achieve through anecdotes as we look to expand data capacity.

Using Appellate Process to Effectuate Systemic Change
Are you frustrated with trial court practices that harm our clients’ interests? Appeals are a good way to effect systemic changes. Appellate courts are often more aware and protective of due process than state legislatures and trial judges. The session will focus on issue preservation, identification of the systemic issues that we want to address on appeal and the best ways to set those appeals by assisting trial counsel with making motions and presenting evidence to support a particular outcome. We will present on specific ways that we have (and are) continue to push the envelope to get rid of racing to the courthouse to establish paternity, terminating parental rights due to a government debt (child support), and having courts accept MATs as successes and not failures. Robyn Veasey and I co-presented this topic at the ABA Conference in April 2022 and the topics keep growing. We currently have two NPR stories on challenging the unconstitutionality of terminating parental rights due to failure to pay child support (with one petition pending at the US Supreme Court).

Last year we were on the receiving end of an ICWA issue at the US Supreme Court, so this is proof that appeals really make a difference.

Prosecutorial misconduct leads to countless wrongful convictions, unfair trials, and unjust plea bargains. But defense attorneys and accused folks often feel completely powerless to effectively defend against prosecutorial power. Outside of courtrooms and oppressed communities, there's very little public attention or knowledge regarding the incredible power that prosecutors hold and the way their decision-making can impact people's lives. Media rarely report on the issue and District Attorney candidates are rarely even asked about the issue of prosecutorial misconduct as something important to their job. This presentation will discuss some of the work that we are doing and explore the following topics:
  • How can we work inside and outside court structures to effectively challenge prosecutorial misconduct?

The Kealoha Case; The largest corruption case in the history of Hawaii
Gerard Puana was framed by the Honolulu Chief of Police (Louis Kealoha) and his wife (Katherine Kealoha), the third-highest ranking prosecutor in the state of Hawaii for a crime he did not commit...stealing their mailbox. After a hung trial, I convinced the US Attorneys Office to dismiss the case and refer it to the FBI. A special prosecutor was appointed by Attorney General Holder which led to the indictment, conviction, and imprisonment of the Kealohas and several other police officers who all conspired to violate my client's civil rights. The grand jury investigation continues to this date with the indictments of other high-ranking state officials, including the chief state prosecutor and the head of the state's corporation counsel, all allegedly involved in a cover up. My book, The Mailbox Conspiracy, details how we uncovered the evidence of the frame up and how we convinced prosecutors to go after these powerful state law enforcement officials.

Relax, shake it out, and move around a little with a low-key yoga class. This customizable practice is friendly to all bodies and all experience levels, and you can give it as much energy as you wish. No prior yoga experience is necessary, and if you are breathing, you are doing it right. (If you are smiling, you are doing amazing.) We will keep it light and breezy. No special equipment is necessary, but loose, comfortable clothing wouldn’t hurt, and enough space to move around without knocking over any piles of files. It’s nice to have a folded blanket or cushion or chair to sit on for Savashana. Drop in, drop out, or come only for relaxation at the end. Let’s support each other in positivity and presence while we breathe and move around a little.

Aiding and Abetting Felony Murder
How to thwart the injustice of murder twice removed?  We are trying in Minnesota to curtail homicidal liability for those who neither have intent, nor pull the trigger. The presentation will begin with a brief overview of the felony-murder doctrine, focusing on the aiding and abetting application. We will discuss the 2018 tragedy in a Minneapolis suburb that incited reform efforts, and talk about framing Aiding and Abetting Felony-Murder in a compelling way for law makers. We will walk through the steps of legislative reform underway now in Minnesota, including the formation of a task force, bill drafting, and lobbying. We will discuss the backdrop of George Floyd’s murder and analyze the legal, data-based, and human aspects of the doctrine applied to killings by police and also, more frequently, weaponized against our clients. We will close with an optimistic look at policy, politics, and prognosis—in Minnesota and around the country—including the implications of reform for our clients and those who once abused Aiding and Abetting Felony-Murder to harm them.

Defending a Case with Ballistic Evidence
Ballistic Evidence has long been admitted in criminal courts throughout the United States. Following the publication of the NAS Report in 2009 and the PCAST Report, Ballistic Evidence has come under increased criticism. This presentation will discuss the substantive and procedural issues involved in litigating Ballistic evidence. We will discuss the actions that should be taken and motions an attorney should file to ensure they are provided full discovery and access to the prosecution’s Ballistic evidence.  This information is necessary for the defense lawyer to prepare for trial and provide the defense expert a fair opportunity to conduct their own investigation.  We will discuss the different ways in which to try and challenge the admissibility of Ballistic evidence.  The presentation will also provide attorneys ideas on trying limit the manner in which Ballistic testimony is presented by the prosecution as well as ways to undermine its persuasiveness with the jury.

Gender Bias in the Cases of Women Facing Extreme Sentences
As a general rule, defense lawyers receive little to no training on the special needs of clients who identify as female. Research conducted by the Cornell Center on the Death Penalty Worldwide shows that gender bias is endemic in the cases of women facing murder charges, and the great majority of women in the criminal legal system are victims of gender-based violence. Yet attorneys don't know how to talk to their women clients about their histories of violence and often fail to object when prosecutors invoke negative gender stereotypes during trial. This presentation will share the results of our research and provide helpful guidance to lawyers, including a link to a practice manual designed for defense lawyers representing women and transgender persons.

Getting the Most out of Brady v. Maryland, Before, During, and After Trial
Every defense attorneys knows about Brady v. Maryland. But unfortunately, we also all know the many ways prosecutors fail to meet their obligations or courts fail to hold them accountable. This presentation will focus on ways to make sure all steps are being taken before, during, and even after trial to get Brady material, and then what arguments can be pursued when the late disclosures are inevitably uncovered.  According to the National Registry of Exonerations, over forty-five percent of all wrongful convictions since 1989 have involved prosecutors failing to disclose exculpatory information. Of those exonerations, ninety-four people had been sentenced to death and another 153 sentenced to life without parole. And just as with every other aspect of the criminal legal system, stark racial disparities exist with who is wrongfully convicted when the prosecution withholds Brady: since 1989, Black people account for fifty-five percent of the exonerations where prosecutors withheld exculpatory information. Clearly, Brady violations cause real harm and aggressive approach is needed at all stages for any hope ensuring it is properly being enforced.

Advocating to reform criminal justice is a steep uphill battle.  And the sisyphean effort can be depleting when the facts and realities clearly support reform, yet the public and policymakers don't pay attention and/or aren't motivated enough to create improvements.  

Concerts for Indigent Defense was created as a way to infuse the energy of music, musicians, and live audiences into your calls for improved public defense services. Created as a ""newsworthy"" platform to enable local defender offices across the country to connect with musicians to declare local Concerts for Indigent Defense in their communities, it leverages Gideon's anniversary as a way to elevate public regard and support for public defense in a major way - while asking extremely little of the defender offices to make it happen.
This program explains in simple terms what Concerts for Indigent Defense is, how it works locally across the country, and why it's a valuable tool for building public support for public defense. As importantly, you'll hear why Concerts for Indigent Defense is appealing to many in the arts, and how the communications director of the Orleans Defender office leveraged Concerts for Indigent Defense to excellent coverage in the past - and intends to keep doing so

Secrets of the Killing State

The death penalty in America is a highly symbolic issue whose chief utility (as this group surely knows!) lies more in politics than crime control. The fact that the death penalty is reserved exclusively for the underclass and inflicted disproportionately upon black and brown bodies plays an important role in these political uses, and lethal injection is the glue that holds it all together. Lethal injection camouflages the violence of state killing, allowing the death penalty's political uses to flourish without drawing attention to the dirty work that executions entail. This presentation is about the various things that this arrangement sweeps under the rug, and will be highlighted from my manuscript "Secrets of the Killing State: The Untold Story of Lethal Injection." You know it's bad, but it's even worse than you think.

RICOCHET TELLS THE STORY of the historic trial following the tragic incident at Pier 14 in San Francisco–when a young woman named Kate Steinle was killed by the ricochet of a bullet accidentally fired by an undocumented immigrant, José Ines García Zaraté. The incident sparked a political and media firestorm–spearheaded by the anti-immigrant rhetoric of presidential candidate Donald J. Trump–that rattled the nation, exploited the tragedy of a family, and demonized an innocent man in the process. Against this backdrop, RICOCHET follows the ensuing trial. The defense is led by a team from the San Francisco Public Defender’s Office featuring Chief Attorney Matt Gonzalez and Francisco Ugarte, Managing Attorney of their Immigration Defense Unit.
