As the Supreme Court has recently emphasized, “Some decisions . . . are reserved for the client.” But not all clients make great decisions, and when they’re making decisions that are harmful for their case, what is the role of defense counsel? This session will address the perpetual challenge public defenders face: the challenging client. Our clients disproportionately suffer mental illness, coercive conditions of confinement, and distrust of the system. These clients do not always trust or want our advice. This session will provide context for why clients are “difficult,” strategies for working with them, and explanation of the ethical and legal obligations these situations can create.
