In the wake of the U.S. Supreme Court’s decision in Dobbs v. Jackson Women’s Health Organization overruling the constitutional right to an abortion, many states have begun enforcing old statutes or enacting new ones that severely restrict access to and provision of reproductive healthcare.  In other states, the right to reproductive freedom is protected under state law.  But people in those “protected” states may nonetheless face legal action from prosecutors in other states who are seeking to enforce their restrictive laws across state lines.  This discussion will discuss potential issues that criminal lawyers might face in defending their clients in these interstate cases.
